Dear Councilors:
As you may be aware, I discovered on May 14, 2010, that members of Lynn’s Zoning Board of Appeals, who have been appointed by the Lynn City Council for at least the past 25 years, are required under state law to be appointed by the Mayor. In order to preserve both the current and past boards, I am taking the following actions:
1. The appointments of all Regular Members of the present Board of Appeals are hereby ratified, and are deemed to have expired as of May 14, 2010.
2. The appointments of all Associate Members of the Board of Appeals, which were designated in accordance with state law, remain unaffected, and those individuals shall continue to serve as Associate Members until their present terms expire.
3. The appointments of all Regular and Associate Members of any past Board of Appeals that were improperly constituted under state law are hereby ratified, as are the dates upon which their terms expired.
4. I have re-appointed, on a temporary basis, the five (5) individuals who have been improperly appointed to the present Board of Appeals. These temporary appointments are effective immediately, and will expire on July 2, 2010.
5. I have placed a posting on the City’s bulletin board advertising five (5) vacancies on the City’s Board of Appeals. Pursuant to the City Charter, this notice will be posted through June 1, 2010. The openings will also be advertised in the Lynn tem and on the City’s website.

Pursuant to Article 2, Section 2-5 of the Lynn City Charter, I hereby designate Jeanne M. Curley to perform the duties of a regular member of the Zoning Board of Appeals. This appointment is effective immediately, and will expire on July 2, 2010. I certify that said person is qualified to perform the duties which will be required and that I make this designation solely in the interests of the City of Lynn.

Donald Walker, Director of Project Operations, Office of Economic & Community Development

Dear Councilors:
On behalf of the Office of Economic and Community Development and the Lynn Housing Authority and Neighborhood Development, I am requesting that you schedule a public hearing with the Lynn City Council on Tuesday, July 13, 2010. The purpose of this hearing is to allow public input to the City’s Five Year Consolidated Plan/Annual Action Plan, including the use of the Department of Housing and Urban Development’s appropriations for the Community Development Block Grant ($2,756,317), Emergency Shelter Grant ($111,328), HOME ($1,084,120) and Housing Opportunities for persons with Aids Programs ($355,028). Upon confirmation of this hearing date, our office will prepare a legal notice that will be advertised n the Daily Evening Item at least two weeks prior to the hearing date.

Everette Bryan, for permission to place approximately 75 feet of underground conduit from existing jointly owned pole on Easterly side, running southerly and easterly to intersection with Oceanside Terrace. Then from existing jointly owned pole on Southerly side of Oceanside Terrace, approximately 110 feet of underground conduit westerly to intersection with Eastern Avenue. (Cyr)
